End-User License Agreement (EULA) for It’s Me, Bobby
This End-User License Agreement (“EULA”) is a legal agreement between you (hereinafter referred to as “User” or “Licensee”) and It’s Me, Bobby (hereinafter referred to as “Website” or “Licensor”) for the use of music files obtained from the Website. By downloading, purchasing, or using any music file from the Website, you agree to be bound by the terms and conditions of this EULA.
1. Listening License:
1.1 Scope of License: The Website grants the User a non-exclusive, non-transferable license to use the music file for personal and public listening.
1.2 Restrictions: The User may not share, distribute, sublicense, or publicly perform the music file on streaming services or social media platforms. However, public performance in venues, events, or gatherings is allowed. The music files cannot be used as a product or part of a product like a video or remix or mashup.
1.3 Ownership: The User acknowledges that all rights, title, and interest in the music file, including but not limited to copyright, remain the property of the Website.
2. Production License:
2.1 Scope of License: The Website grants the User a non-exclusive, non-transferable license to use the music file in a product (e.g., video) for commercial or non-commercial purposes. This license also covers the scope of ‘Listening License’.
2.2 Restrictions: The User may use the product (e.g., video) anywhere without limitations. The User may not sell, distribute, or sublicense the music file independently.
2.3 Ownership: The User acknowledges that all rights, title, and interest in the music file, including but not limited to copyright, remain the property of the Website.
3. Exclusive Ownership License:
3.1 Scope of License: The Website grants the User an exclusive, transferable license to become the sole owner of the music file.
3.2 Scope of License Upon obtaining exclusive ownership, the User may use, modify, and distribute the music file without limitations. The Website will disown and remove the music file from its platform.
3.3 Prior Shared Rights: The User acknowledges that shared rights under Licenses 1 and 2, sold until the date of exclusive ownership, remain valid and are not affected by the exclusive ownership transfer.
3.4 No Further Rights for Website: Once exclusive ownership is transferred, It’s Me, Bobby relinquishes all rights, title, and interest in the music file, and the User becomes the sole owner.
General Provisions:
4.1 Termination: The Website reserves the right to terminate any license if the User breaches any terms of this EULA.
4.2 Governing Law: This EULA shall be governed by and construed in accordance with the laws of Panchkula, Haryana, India, without regard to its conflict of law principles.
4.3 Entire Agreement: This EULA constitutes the entire agreement between the User and the Website and supersedes all prior agreements or understandings.
By accepting this EULA, the User agrees to comply with all terms and conditions outlined herein. If you do not agree with any of the terms, you are not authorized to use the music files from It’s Me, Bobby.
